American singer-songwriter and actress Miley Cyrus is now facing a legal battle for her song “Flowers,” which won a Grammy Award. The lawsuit was filed on August 16 by Tempo Music Investments, which is also one of the leading music investment companies. In the reports, it was alleged that the 2023 song, which instantly became a hit, contains some of the portions from Bruno Mars’s 2013 song “When I Was Your Man.” Additionally, the allegations were also made against Gregory Hein and Michael Pollack, who were the co-writers of Flowers.
The publishing companies, Sony Music Publishing, Apple, Target, and Apple have also been accused of distributing the track. It claimed that the Flowers consisted of “unauthorized exploration”, according to a report published by The Guardian.
The lawsuit alleges, “Any fan of Bruno Mars’ When I Was Your Man knows that Miley Cyrus’s Flowers did not achieve all of that success on its own. Flowers duplicate numerous melodic, harmonic, and lyrical elements of When I Was Your Man, including the melodic pitch design and sequence of the verse, the connecting bass line, certain bars of the chorus, certain theatrical music elements, lyric elements, and specific chord progressions.”
Later on, the lawsuit also claimed that the allegation was undeniable owing to the major similarities between the recordings, further adding that Miley Cyrus’s song would not exist without When I Was Your Man. The allegation read, “It is undeniable based on the combination and number of similarities between the two recordings that Flowers would not exist without When I Was Your Man. With Flowers, Cyrus, Hein, and Pollack have created a derivative work of “When I Was Your Man without authorization.”
A lead single from 2023, Endless Summer Vacation was sung by Miley Cyrus. After its debut, it topped the Billboard Top 100 bringing the top streams for the week, and has more than 100 million listeners.
